Buckley was first star and made team of the day. My goalie wasn't even one of the three stars. This was probably when his Team Strength was ~190 while I might have been around 120. Popularity is the only reason why that could have ever happened.

is this some kind of joke last few weeks? In next 4 matches (links) I have 177 shots fired, and my opponents only 53 shots. In 3 out of 4 matches I had better shooting, in all 4 I had better goalie and total domination. I won 1 match on penalties and lost 3 matches... 5 goals scored (6th goal scored was on penalties), and 10 goals in my net..

Actually, after just a quick glance ... I'd say you need to train more shooting. Your offense and defense are great, shooting is far in the back. You said it, 177 shots and only 5 goals scored. On other hand, you only had better goalie in one match, other three matches you didn't.
Only the first match is flawed I'd say, and I saw worse than that. Work on that shooting and soon the results will get better.

I have a question about Clause 33 of the new ToS:

"The operator reserves the right to send information about the PowerPlay Manager project or about its partners to the user's e-mail address, which the user explicitly agrees with by agreeing with these ToS. The user can withdraw the approval of the sending of these newsletters, given to the operator, at any time via e-mail. However, the user is aware that by withdrawing the approval of these newsletters, the user loses the right to his/her user account and the operator is entitled to delete the user's account in the game. In such instances, the user is not entitled to claim the refund of money for the credits spent to purchase virtual services of the PRO and PLUS feature packs, the refund of money for the remaining credits on the user's account, and/or the refund of costs, if any, in connection with the provision of the user account."

This is requiring me to agree to have PPM spam my email address with information about their partners. I already pay the propack (And have for about 3 years) and put up with advertisement, I put up with the new click on popup for your other projects, I do not need more emails to be sent to me. Can I have more information about this clause, its intent and planned use?

I agree. We are being forced to receive spam? The timing of this change seems odd. Right after a big credit sale. I would also like more information.

I too would like to know why this clause is inserted into the ToS.

Very suspicious to put in and kind of unfair that we aren't allowed to opt out.

Is it even legal? We had a ToS beforehand that we agreed to - I'm assuming this is one of the new statements. Prior to the change, we further agree by buying credits due to a handy sale - and then now what we've agreed to has suddenly changed? Why was this strategy used? I find it unfavorable.

Section 31 gives you 7 days to opt out (and cancel your account) by e-mailing them.

Although the ToS change right after the sale is suspicious. You can get a refund of 0.075 Euro per credit. There is also a refund fee (I think it is 10 Euro)... Ignore the fact that it costs over 0.10 Euro per credit.

General rule of most websites is TOS can change at the operators decision without need for approval from members. ebay, Google etc do it all the time.

But.. don't want the emails? Set up a filter on your email to send them direct to the trash or another folder so you never see them. There, easily fixed.

Now... IF PPM were smart, they would put a link in these emails, that when clicked gives the manager a small bonus. Incentive to read them.

They can change their ToS, but there must be a period of time until the changes take effect.
It is impossible for changes to occur and be effective at the same time. How can I legally consent to something before I've had a chance to read it?

eBay's ToS changes take effect 30 days after posting.



eBay's clause:
"We may amend this User Agreement at any time by posting the amended terms on www.ebay.com. Our right to amend the User Agreement includes the right to modify, add to, or remove terms in the User Agreement. Except as stated otherwise in this User Agreement or elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted. Additionally, we will notify you through the eBay Message Center. "


Google's clause:
"We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retrospectively and will become effective no earlier than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service. "


You'll notice that their changes don't take effect immediately. I once again question the legality of changing the ToS without a chance to read it.

Granted, they do give a time period.

However, i don't believe they NEED to, if they don't want to.

Also, for the record, the "law" on the net is a grey area. The law that applies would be the one in the country which the server is based. So, if PPMs hosting was done on US soil, then it would be U.S. law (no warning needed for change of TOS).

It looks to me like PPM hosting is done in the Czech Republic, so you would need to look at their laws.

Oh boy, nothing happened (regarding spam mail) and there is serious concern over it. As TB said - you just set filter for unwanted mail and you are done with it, if it ever happens that is.
Frankly, I don't read those ToS, it's not that I'm obligated to give them my credit account or something similar.

This is not new at all, it has been there since the first version of ToS.

In reality, we do not delete user accounts of users who want to unsubscribe. It is our policy, but if we decide to change that (which is unlikely), this section gives us the right to remove such accounts. In the past, we really did that, but then we changed our policy.

There is in fact an unsubscribe link in the promotional emails that we send and it doesn't delete your account, only unsubscribes you.

And for the record, the timing of the new ToS has nothing to do with the "sale" of credits. It just so happened that we finished them yesterday.
